COMMERCIALIZATION OF WAQF (COMPARATIVE STUDY OF MAZHAB HANAFI AND MAZHAB SYAFI’I) Indonesia

Abstract

Abstrack: Waqf is very potential to play a role in the socio-economic life of the people in the present and the future, thii is realized and achieved if managed properly and professionally. Things are quite encouraging lately are many people, who are interested in commercializing endowments in whole on in part. In Islamic law (Fiqh) regarding the problem of the use of this waqf goods there are many opinions among scholar’s Madzhab. In this discussion, writing will only present the opinions of the Hanafi and syafi’i schools by displaying some references (books an kitab) wich are expected to represent the two schools of thought. Departing from differences of opinion between the Hanafi and Syafi’i schools regarding yhe use of waqf goods. We as authors of this scientific work try to find out deeply about the form of endowment commercialization of the two schools and the differences and similarities, if related to various waqf problems that occur  at this time it is also important to know wich opinion is most in line whit the current conditions and situations so that the benefit which is the main objective of Islamic law and be realized.
